Terms of service

1. Agreement

By accessing the Site, creating an account, submitting a venue registration request, or using the Services on behalf of yourself or a business, you agree to these Terms. If you do not agree, do not use the Site or Services. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The Services

Eat 'n Drink provides tools for hospitality venues, including digital menus, optional guest features (such as ordering or waiter calls, where enabled), and dashboards for venue staff. Features available to guests depend on settings controlled by each venue. We may change, suspend, or discontinue parts of the Services with reasonable notice where practicable.

3. Accounts and acceptable use

You agree to provide accurate information, keep credentials confidential, and notify us if you suspect unauthorised access.

You must not:

• use the Services in violation of law or third-party rights;
• attempt to gain unauthorised access to systems, data, or accounts;
• overload, probe, or circumvent security or usage limits;
• upload malware or unlawful content;
• use the Services to send spam or misleading communications.

We may suspend or terminate access for conduct that we reasonably believe breaches these Terms or risks the Services or other users.

4. Venues and guest interactions

Each venue is responsible for its menu content, pricing, guest service, compliance with food safety and consumer rules, and how it uses guest data in its own operations. Orders and payments described in the product as “pay at venue” or similar are fulfilled by the venue, not by us as a payment processor unless we expressly state otherwise in writing.

5. Intellectual property

We retain rights in the Site, Services, branding, and software. You retain rights in content you upload (for example logos and menu text) and grant us a licence to host, process, and display that content as needed to provide the Services to you and your guests.

6. Privacy

Our processing of personal data is described in the Privacy policy. By using the Services you acknowledge that processing may occur as described there.

7. Disclaimers

The Services are provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free. Your use of the Site and Services is at your own risk.

8. Limitation of liability

To the maximum extent permitted by applicable law, Manifesto Business and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services. Our aggregate liability for claims arising out of or related to these Terms or the Services shall not exceed the amounts you paid us specifically for the Services in the three (3) months preceding the claim (or, if none, fifty euros (EUR 50)).

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.

9. Indemnity

You will defend and indemnify Manifesto Business against claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your breach of these Terms, or your misuse of the Services, except to the extent caused by our wilful misconduct.

10. Governing law and disputes

These Terms are governed by the laws of the Republic of Albania, without regard to conflict-of-law rules. Courts located in Albania shall have exclusive jurisdiction over disputes, subject to any mandatory rights you may have as a consumer in your country of residence.

11. Changes

We may update these Terms by posting a new version on this page and updating the “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms, except where stricter notice is required by law.
